Is criminal law reform waiting for us? Despite the decrease in crime, Slovenia has the second largest prison population in the EU

At the same time, the government declares its intention to reform criminal law so that it corresponds to European standards and current trends in the criminal policy of the most developed countries of the European Union. The cabinet wants to implement the adoption of this legal regulation by transplanting the acute amendment of the Criminal Code and the Criminal Code and the subsequent complex re-recording of the Criminal Code.

“It must be admitted that it has already been a failure of several previous governments to correct at least the most glaring shortcomings of this (Trestného, ​​late SITA) of the law. At the moment, however, the misuse and abuse of criminal law resources by the previous government led to the exposure of these shortcomings to the public and strengthened the resistance of the public and legal practice to the existing legislation,” the material states.

We have the second largest prison population in the EU

At the same time, he states that, despite the decrease in registered crimes, the number of prisoners in the Slovak Republic has not increased in the last 10 years, on the contrary, it has slightly increased, and Slovenia is the country with the second largest number of prisoners per 100,000 inhabitants in the EU.

“Therefore, the government will prioritize the formulation of strategic objectives of criminal policy with an emphasis on measures of restorative justice,” it is stated in the documents, that the goals of specific measures are mainly focused on the humanization of the conditions of imprisonment in accordance with the recommendations of international institutions, the reduction of the number of persons sentenced to life imprisonment, the development of a functioning model of probation and mediation services, and ensuring the real possibility of arranging alternative trusts in the home prison and prison sentence to a greater extent than before.

At the same time, the document emphasizes that the current government, despite its predecessors, has changed the area of ​​pre-court criminal proceedings to “war zone“, there will be no rematch.
